Introduction

Welcome to MindoryApp, operated by AutiHD S.à r.l. These Terms and Conditions govern your access to and use of MindoryApp and all related services.

By accessing or using the app, you agree to be bound by these Terms. If you do not agree, you must not use the app.

Definitions

“App” refers to the MindoryApp mobile application.
“User” refers to any person who accesses or uses the app.
“We”, “us”, and “our” refer to AutiHD S.à r.l.

Eligibility and Age Requirement

MindoryApp is intended for use by adults only.

By accessing or using the app, you confirm that you are at least 18 years old (or the age of majority in your country) and legally capable of entering into these Terms.

MindoryApp is not designed for children. We do not knowingly permit individuals under 18 to create an account or use the app. If we become aware that a minor is using MindoryApp, we reserve the right to terminate the account and delete any associated data.

Parents and legal guardians are responsible for preventing children from accessing MindoryApp.

Health and Medical Disclaimer

MindoryApp is not a medical device and does not provide medical, psychological, or therapeutic services. The app is intended to support organization, well-being, and self-reflection only.

MindoryApp does not provide diagnoses, treatment, or medical advice and is not a substitute for professional healthcare.

If you experience severe distress, a mental health crisis, or medical symptoms, you must seek help from qualified healthcare professionals or emergency services.

AI Features and Disclaimer

MindoryApp includes features powered by artificial intelligence. These features provide automated responses and suggestions based on user input.

You acknowledge and agree that:

• AI-generated content may be inaccurate, incomplete, misleading, or inappropriate

• AI features are provided for supportive and informational purposes only

• AI outputs must not be relied upon as medical, psychological, legal, or professional advice

AutiHD does not guarantee the accuracy, quality, or suitability of AI-generated content and is not responsible for decisions made based on such content.

You are solely responsible for how you use AI-generated information within MindoryApp.

User Accounts

Certain features require account creation. You agree to provide accurate and complete information and to keep it up to date.

You are responsible for safeguarding your login credentials and for all activity that occurs under your account.

We may suspend or terminate accounts if these Terms are violated, misuse occurs, or continued use may harm users, the app, or AutiHD.

You may delete your account at any time.

Subscriptions, Free Trial, and Payments

MindoryApp offers paid subscription plans, including monthly, three-month, and yearly subscriptions. Subscription details, pricing, and available features are displayed in the app at the time of purchase.

7-Day Free Trial

All first-time users receive an automatic 7-day free trial. No payment details are required to start the free trial.

After the 7-day free trial ends, you will be invited to start a paid subscription. You may choose to subscribe or decline. If you decline, access to paid features will end.

Starting a paid subscription is optional and requires your explicit confirmation.

Billing and Renewal

If you choose to start a paid subscription, it is billed in advance and automatically renews unless cancelled through your Apple ID or Google Play account settings at least 24 hours before the end of the current billing period.

Your account will be charged for renewal within 24 hours prior to the end of the current subscription period.

Payments are processed through the Apple App Store or Google Play Store, in accordance with their terms.

Managing and Cancelling Subscriptions

You may manage or cancel your subscription at any time through your device’s account settings. Deleting the app does not cancel your subscription.

Price Changes

We reserve the right to change subscription pricing. Where required, you will be notified in advance. Changes take effect at the start of the next billing period.

Refunds

All purchases are generally non-refundable. Refund requests are handled by Apple or Google in accordance with their policies. AutiHD does not directly process refunds for in-app purchases.

Acceptable Use

You agree to use MindoryApp only for lawful purposes and in accordance with these Terms.

You must not:

• violate applicable laws or regulations

• misuse, disrupt, or damage the app

• attempt unauthorized access to systems or data

• introduce malware or harmful code

• abuse, harass, or harm others

• misuse AI features in an illegal or harmful way

Intellectual Property

All content, software, design, text, graphics, logos, and features are owned by or licensed to AutiHD and protected by intellectual property laws.

You are granted a limited, non-exclusive, non-transferable, revocable license to use the app for personal, non-commercial purposes only.

Privacy

Your use of MindoryApp is governed by our Privacy Policy, which explains how personal data is collected and processed.

Third-Party Services

MindoryApp may integrate or link to third-party services. AutiHD is not responsible for third-party content, services, or policies.

Availability and Changes

We may modify, suspend, or discontinue any part of the app at any time without liability. Features may change, evolve, or be removed.

Limitation of Liability

To the fullest extent permitted by law, AutiHD shall not be liable for any indirect, incidental, consequential, special, or punitive damages, including loss of profits, data, business, goodwill, or personal outcomes.

AutiHD is not liable for:

• use or inability to use the app

• reliance on app content or AI responses

• data loss or system interruptions

• unauthorized access

• third-party actions or content

Use of MindoryApp is at your own risk.

Indemnification

You agree to indemnify, defend, and hold harmless AutiHD, its affiliates, and their officers, directors, employees, and partners from any claims, damages, losses, liabilities, and expenses, including legal fees, arising from:

• your use of the app

• your violation of these Terms

• your violation of any law or third-party rights

Termination

We may terminate or suspend your access immediately if you breach these Terms. Upon termination, your right to use the app ends.

Governing Law

These Terms are governed by and construed in accordance with the laws of Luxembourg, without regard to conflict-of-law principles.

Changes to These Terms

We may update these Terms from time to time. Changes become effective once posted. Continued use of the app means acceptance of the revised Terms.

Apple-Specific End-User License Agreement Terms

If you use MindoryApp on an Apple-branded device, you acknowledge and agree that:

This agreement is between you and AutiHD, not Apple.

1. Apple has no responsibility for the app or its support.

2. Apple may refund the purchase price if the app fails to conform to warranty, but has no further obligations.

3. AutiHD is responsible for addressing claims related to the app.

4. You represent that you are not located in a prohibited or embargoed country.

5. Apple and its subsidiaries are third-party beneficiaries and may enforce these Terms.
